Robert F. Kennedy Jr., an independent presidential candidate, has been barred from appearing on the general election ballot in New York.
The decision was made by Democrat Judge Christina Ryba, who ruled that Kennedy’s claim of a New York address as his “place of residence” was false and that he had no genuine intention of returning to the state.
This ruling is seen as part of a DNC-supported effort to undermine Kennedy’s candidacy, despite his strong grassroots support, which includes over 1 million signatures nationwide, with nearly 150,000 collected in New York alone.
The lawsuit against Kennedy is backed by Clear Choice Action, a super PAC aligned with the Democratic Party that aims to obstruct third-party candidates in the presidential election.
If this ruling stands, it not only prevents Kennedy from being on the New York ballot but could also set a precedent for challenges in other states where he used a New York suburban address to gather signatures.

Judge Ryba determined that Kennedy’s connections to the New York address were purely nominal and kept for political advantage.
“The overwhelming credible evidence introduced at trial established that Kennedy’s connections with the [New York] address existed only on paper and were maintained for the sole purpose of maintaining his voter registration and political standing in the State of New York,” she wrote.
Kennedy’s campaign strongly denounced what they labeled as a “blatantly partisan decision.”
They assert that the judge disregarded compelling evidence backing Kennedy’s extensive connections to New York.
The campaign emphasized in a statement that Kennedy is a registered voter in New York, has been living there since 1964, pays taxes in the state, and holds multiple licenses issued by New York authorities.
“We intend to pursue injunctive relief in the Southern District of New York,” stated campaign Senior Counsel Paul Rossi. “If state court judges are going to ignore the Constitution, the federal courts must step in to protect voters’ rights.”
Kennedy stated during court proceedings last week that he views New York as his home and plans to go back there after temporarily moving to California in 2014 to live with his wife.
The Constitution sets forth three requirements for the presidency: candidates must be at least 35 years old, natural-born citizens, and have resided in the United States for a minimum of 14 years.
Elon Musk supported RFK Jr’s right to appear on the ballot, stating, “The relentless lawfare to undermine the people’s right to vote for their candidate of choice has to stop!”
During a CBS 6 Albany interview, RFK Jr. alleged that the Democrat Party has politicized the courts and used enforcement agencies against him. He discussed difficulties in obtaining Secret Service protection and highlighted a lawsuit victory against the Biden administration over purported censorship efforts by federal agencies.
“That’s not the Democratic Party I grew up with,” he lamented. “That Democratic Party was fighting for voting rights, not fighting to deprive people of their votes.”
