On Thursday, Judge Tanya Chutkan conducted a status conference to address the Supreme Court’s ruling on presidential immunity in the case of Jack Smith against Trump related to the events of January 6.
Judge Chutkan strongly criticized the Supreme Court’s decision on presidential immunity and emphasized that the upcoming election is not relevant.
Although she did not issue a ruling, it is anticipated that she will release a scheduling order by Thursday evening.
President Trump and Special Counsel Jack Smith presented differing arguments regarding the progression of the January 6 case in a joint status report filed last Friday in anticipation of the status conference.
Following the Supreme Court’s ruling on presidential immunity, Jack Smith re-indicted President Trump in DC last Tuesday.
The grand jury indicted Trump on four charges: conspiracy to defraud the United States, conspiracy to obstruct an official proceeding, obstruction of and attempt to obstruct an official proceeding, and conspiracy against rights – which were initially unveiled last August.
Trump’s legal team argued that he is immune from federal prosecution for alleged offenses committed during his tenure as US President.
According to Julie Kelly, who attended the status conference, Judge Chutkan was unprepared, smug, and condescending during Thursday’s hearing.

Chutkan engaged in repeated arguments with Trump’s attorneys regarding various aspects of the Supreme Court’s opinion.

Judge Chutkan said the upcoming election is “not relevant.”
“I understand there is an election” soon, Chutkan said.
“It is not relevant. This court is not concerned with the electoral schedule. It is nothing I will consider,” she said.
Chutkan, as she has said consistently since this case landed on her docket, emotionally emphasized that the presidential election will not affect her scheduling order, which she will file later today.
