In July, the Supreme Court decided that former presidents such as Donald Trump are at least partially protected from being prosecuted for their actions while in office. However, it seems that not everyone is aware of or willing to follow this important ruling.
During a heated hearing on Thursday regarding Trump’s federal 2020 election-related case, D.C. District Judge Tanya Chutkan openly scoffed at the SCOTUS immunity ruling when it was brought up by one of Trump’s attorneys, as reported by The Federalist.
This was just one example of the judge displaying her clear bias against Trump and preference for the federal prosecutors who are seeking to convict and imprison him for his actions after the 2020 election.
In July, the Supreme Court made two significant rulings.
The first ruling granted former presidents complete immunity from criminal prosecution for their essential constitutional duties and presumed immunity for all “official acts.”
It also stated that none of their core official acts could be used as evidence against them. Shortly after, another ruling from the high court questioned and largely invalidated the Justice Department’s use of a specific obstruction charge against Jan. 6 Capitol riot defendants, including former President Trump.
It appears that Special Counsel Jack Smith and Judge Chutkan did not hold these major opinions in high regard.
Despite Smith recently filing a revised criminal indictment against Trump with narrowed allegations, it still includes the controversial obstruction charge and presumptively immune official acts as charged offenses and evidence of other alleged crimes.
During the hearing on Thursday, as reported by the New York Times, Trump’s lawyer John Lauro mentioned the Supreme Court’s “clear” immunity ruling but was met with laughter and a dismissive gesture from Judge Chutkan.
When the attorney argued that certain parts of the indictment should be protected under official acts immunity, referencing his interactions with Vice President Mike Pence related to the election, the judge seemed to disregard the Supreme Court’s opinion and asserted that she would determine what constituted an “official” act.
Additionally, when Lauro pointed to Justice Clarence Thomas’ concurrence in the immunity ruling, which raised concerns about Special Counsel Smith’s appointment and funding leading to the dismissal of Trump’s case involving classified documents in South Florida, Chutkan expressed disdain for Thomas’ and Judge Aileen Cannon’s written opinions, deeming them unpersuasive.
Regrettably, these were not the sole instances of Judge Chutkan’s bias against former President Trump. She also approved an unprecedented request for prosecutors to unveil a special brief shortly before November’s election.
This brief will detail and elaborate on the criminal allegations against the GOP nominee, leaving him with no effective means to counter what is sure to be a politically damaging document.
When Trump’s attorney Lauro objected to the egregious timing of what amounts to a partisan opposition research dump right before voters cast their ballots, Chutkan fired back that the impending election was “not relevant here” and “nothing I’m going to consider.”
Later during the hearing, when Lauro again referenced how unfair the timing of the special counsel’s evidentiary brief would be, the judge chastised him and said, “It strikes me that what you’re trying to do is affect the presentation of evidence in this case so as to not impinge on an election.”
The journalist from The Times couldn’t help but note in his report on the hearing that Judge Chutkan was displaying a noticeable edge with Trump’s lawyer.
Ultimately, the judge appeared to express regret that her rulings on the former president’s immunity would be contested regardless of the outcome. Consequently, she declined to schedule a future trial date, stating that it would be “pointless” to do so.
