Pro-life father Mark Houck is suing the DOJ over his arrest and malicious prosecution. Houck was arrested after he defended his son from an unhinged leftist who was harassing his young son.
Houck merely pushed him back and neither he nor his son were even remotely close to the entrance of the abortion clinic.
The FBI raided his home and despite the fact that he stepped outside of his house and submitted to arrest, heavily armed FBI agents held guns on his wife and seven children.
Houck was facing 11 years in prison and a fine of $350,000 dollars. In January, Houck was acquitted of the Freedom of Access to Clinic Entrances a.k.a. FACE Act charges.
Houck is seeking $1.1 million dollars for malicious prosecution, retaliatory prosecution, false arrest, abuse of process, and assault.
The suit describes the infamous arrest as:
“unnecessary and unlawful show of force” and an infringement of Houck’s Fourth Amendment rights. Officers used “excessive force” to arrest the activist on “non-violent charges when he had not threatened law enforcement, did not own a gun, and had offered to turn himself in to authorities if indicted.”
His wife, Ryan-Marie Houck, is seeking $3.25 million in damages:
“Mrs. Houck has also shouldered the emotional distress of caring for her seven children and their individual needs as they each process their own trauma from these events. The children continually come to her crying and suffering from nightmares. They slept in bed with her and her husband for the first month after the arrest, and they continue to ask to sleep in their parents’ bed. The children are easily triggered whenever the situation is brought up or unannounced guests arrive at the property, and she spends a significant amount of time counseling and comforting them.”

In the aftermath of the arrest, a fundraising account on platform GiveSendGo set up for the Houck’s described the incident as follows: “Mark and his son were praying in front of the [Planned Parenthood] at 12th and Locust. When one of the escorts began harassing Mark’s son they walked down the street away from the entrance to the building. The escort followed them, and when he continued yelling at Mark’s son, Mark pushed him away.”
“It’s all on video,” the post continues. “But that hasn’t stopped Planned Parenthood and the Biden Administration. With no prior warning, and in spite of the fact that Mark is represented by an attorney, Biden’s Justice Department sent a fully armed SWAT team into a home full of young children at daybreak, to arrest a father for protecting his son.”

The Biden administration with Garland is perfectly happy to trample on people’s rights in an effort to quite conservative pushback. They don’t care about the truth, justice or individual liberty but are more worried about using the legal system to intimidate the populous especially conservatives. Just more proof that the FBI needs to be defunded and dismantled, with almost EVERY agent and employee terminated and barred from future federal employment.
After deducting FBI funding from DOJ funding, the remaining DOJ budget needs to be cut by AT LEAST 50%. The number of sitting US attorneys (and districts) needs to be cut by 50%, and the size of each US attorney’s lawyer staff should be cut by 75%. Then the non-personnel budget of each office needs to be cut by 75% so that they cannot go out and contract “lawyers for hire”. DOJ (specifically the US district that initiated the prosecution, and FBI) should pay to acquitted citizens 5X of their legal fees). US attorneys, and their legal teams should be held CRIMINALLY liable when they withhold exculpatory evidence. Their punishment should be whatever sentence would have befallen the acquitted citizen, had he or she been convicted. Finally, all jurors in federal cases MUST be informed of their right/power of jury nullification. DOJ can get away with this lawfare because they have unlimited budgets, and armies of lawyers with which to harass American citizens.

THis is just another example of how Garland thinks he is above the law. IF this trial proceeds, Garland & Wray should be fired. They are lawless thugs who think they law does not apply to them.
