A political controversy is brewing in Arizona as several sheriffs along the southern border have announced they will refuse to enforce a proposed state law aimed at criminalizing illegal border crossings.
Proposition 314, which will be on the November ballot, would grant local law enforcement the power to arrest and prosecute migrants who enter the U.S. unlawfully.
The Arizona legislature’s website outlines that Proposition 314 would impose criminal penalties on individuals who are in the U.S. illegally and submit false documentation when applying for public benefits or during the employment verification process.
It also targets fentanyl trafficking, making it a felony to knowingly sell the drug if it’s illegally imported or causes death. Additionally, the proposition would criminalize unauthorized entry into the state, outside of legal ports of entry.
Several sheriffs, particularly in border counties, are voicing opposition to the measure. Santa Cruz County Sheriff David Hathaway, a Democrat, has called the proposed law “racist” and impractical.
“It would be ridiculous for me to go up to practically every single person in my county and say, ‘Let me see your papers,’” Hathaway said, citing concerns over racial profiling.
His stance has drawn attention from both sides of the political spectrum.
Pima County Sheriff Chris Nanos, also a Democrat, echoed similar sentiments, stating he would not enforce the law due to the potential for racial profiling and the financial burden it would place on local law enforcement.
“If I book a migrant in my county jail, I’m paying for those costs without any funding from the state,” Nanos said, highlighting the lack of state and federal resources to support the enforcement of such measures.
He criticized the federal government for failing to address the broader immigration crisis and argued that local authorities should not bear the responsibility for enforcing immigration laws.
Sheriffs like Nanos also emphasized logistical challenges, including overcrowded jails and an overburdened court system. Nanos pointed out that the federal government lacks sufficient courts, judges, and attorneys to manage the flow of immigration cases.
“I’m not going to allow my deputies to be on that border, to arrest people, to book them in our jail when we have a federal government that has that responsibility,” he said, calling for federal immigration reform.
While some sheriffs oppose the proposition, others have a more nuanced view. Cochise County Sheriff Mark Dannels, a Republican, stated that while he understands the intent behind Proposition 314 and expects it to pass due to strong public support, the lack of infrastructure and resources could hinder enforcement.
“Will I enforce the law? Yes, because you have to enforce the will of the people,” Dannels said, but he expressed concern over the funding and personnel required to effectively carry out the law.
On the western side of the Arizona-Mexico border, Yuma County Sheriff Leon Wilmot has been less vocal but previously warned that enforcing the law could strain his county’s budget.
Wilmot, a Republican, told local news outlets that Yuma lacks the financial resources to manage the potential influx of arrests if Proposition 314 becomes law.
The debate highlights the ongoing tension between state and federal roles in managing border security and immigration policy, as well as the broader challenges of funding and enforcing immigration laws at the local level.
